Conditions of sale
In order to learn more about benefits of proposed services we invite you to get acquaintance of particular and general conditions of sales. These conditions of sale are applied to proposals of site kazantipvoyage.com. Booking and / or control of services is up to the Buyer who has read these terms and conditions and accepted them. Thus, making any booking means compliance of these conditions of sale and acceptance of all of their provisions.
The general conditions of sale are valid since January, 1 2013. This edition cancels and replaces the previous ones.
Definitions
- Organiser legal entity "FLP Chabin"
"FLP Chabin" is the private enterpreneur situated in Simferopol Ukraine, officially registered in Ukraine for the business activity : services of organization of voyages 2 882 000 0000 017 226, tax payer identification number 2406019593
- Buyer means any person who books, orders and/or purchases a service offered by the Organiser, such as accommodation, car rental, provision of packages / package tours or other services.
- Package / touristic services - consist of different services, sold for an aggregate price, exceeding 24 hours or including overnight accommodation. Package combines at least two of three following services:
- Provision of transport or car rental
- Accommodation
- Any service except of transport or accommodation, but representing a significant share of the overall price.
The Buyer guarantees his ability to sign a contract, i.e. to be at least of 18 years old, legally capable of contracting and not to be under guardianship. The Buyer guarantees the truthfulness and accuracy of information supplied by him or any other member of his family.
Execution, modification or cancellation of your order
You can make a booking of desired services on the site kazantipvoyage.com. Organiser will send you an e-mail with the confirmation of your order, containing essential elements such as the price, quantity, dates of the trip. If confirmation issued by Organiser by e-mail is absent, your booking is not considered to be done. It is your responsibility in all cases to ensure the safe receipt of email confirmation. The confirmation email is not a definite confirmation of the order but it means that you have passed your registration correctly.
Any demand of modification or cancellation of your order must be sent to Organiser by email ONLY, in French or in English to the address: contact@kazantipvoyage.com
Organiser will send you back a confirmation email in case of demand for modification or cancellation. If confirmation issued by Organiser by e-mail is absent, your modification or cancellation isn’t considered to be done. It is your responsibility in all cases to ensure the safe receipt of email confirmation. In case of any modification or cancellation, and after deduction of amounts owed (see Section cancellation and modification fees), Organiser will refund your previous payments within a reasonable time.
Certain products or offers cannot be an object of any modification or cancellation. So the money paid in such case cannot be an object of any refund. It is agreed that, except of reported errors, the data stored in the information system Organiser and/or its partners have probative value as to orders. Data stored on computer or database of Organiser constitute proof and, if given as evidence by Organiser in any litigation or otherwise, will be admissible, valid and enforceable between the parties in the same way, in the same conditions and with the same value as any written document that would be created, received or retained.
Performing the services
It is necessary to indicate the date by which the parties agree to provide the service. In a contract for the sale of travel packages or non-standard tourist services, the deadline for implementing the benefit is the date of departure.
Price and payments
All prices are in Euros, including all taxes (excepting any costs of management, issuing and / or delivery). Under VAT regime, the organiser located outside the EU does not collect VAT. Invoices issued by the Organiser do not mention VAT.
Additional local taxes may be imposed by local authorities in some countries. In this case, taxes are paid by the Buyer on point in local currency, Euros or dollars. Prices are established on the basis of tariffs and exchange rates indicated below and they can be revised. Please ask for the confirmation of price before your registration.
All the prices are valid at the time of booking. For customers who have already registered, the period of upward revision of the price of trip cannot be less than thirty days before the date of departure.
The Buyer has several modes of payment
- credit cards
- bank transfer SWIFT (only in euros). For any booking made at minimum 60 days before departure, and for an amount superior or equal to 500 euros, Organiser accepts payments by bank transfer but only in euros. The steps for this mode of payment:
1. Book on the website
2. Give your credit card data for guaranty. Providing us your Visa or MasterCard account you confirm the pre-authorization of an amount corresponding to the amount that has to be paid. Your bank account will not be debited.
3. Contact us immediately to inform that you want to make a payment by the bank transfer.
4. You receive a contract with our banking coordinates.
5. You make a transfer within 3 days after your booking.
- Cash (only in euros). The Organiser accepts payments by cash on place in euros.
- bank (travellers) check (only in euros). The Organiser does not accept any payments with bank (travellers) checks.
- vacation checks. The Organiser does not accept any payments with vacation checks.
- Gift-checks. The Organiser does not accept any gift-checks.
We submit your order via a booking form. A partial payment is required while booking. Your personal file is confirmed only when this payment is done. All the bank transfers should be made in Euros only. Payments may cause additional bank expenses, that should be paid by the Buyer himself. Absence of the payment causes Organiser to consider that the Buyer cancelled his booking. Before reception of partial payment the Organiser is not obliged to make any bookings.
However, the Buyer remains responsible for the payment of all amounts agreed for the products or services ordered. Failure of payment terms will be considered by the Organiser as a cancellation of a booking by the Buyer. In case if a payment is irregular, incomplete or absent for any reason, the booking of services is cancelled, and the Buyer pays all the expenses.
To minimise the consequences of fraud, Organiser reserves the right to conduct random audits and require the Buyer to fax or e-mail any proofs required of address and an identity
Providing us your credi card account (the MasterCard or Visa products are accepted) you confirm the pre-authorization of an amount corresponding to the amount that has to be paid. Your bank account will not be automatically debited. It will be debited only if your booking is confirmed. Debiting of your card usually takes place within 7 days after your booking.
- Confidentiality and security
You put your personal card data only to the interface of the payment system of our provider UPC, via the secured page, where you are redirected for the payment. The servers of the UPC use the newest and the most reliable technologies of online security that encrypt your personal data while operating. The method used by the UPC is the technology Secure Socket Layer (SSL) and the SSL license provided by Thawte.
Formalities
Information provided by Organiser may change even after your submission. It is up to the Client to verify different formalities, necessary for the realisation of reserved trip. Organiser can’t be in any case responsible, if the Client is refused on embarkation or access to the country of transit or of destination for lack of formalities of police, of health or of customs. The Client is the only one who is responsible for any sanction and/or fine resulted on non-observation of regulations of police, health or customs officer, as well as for any consequences of it. The operator cannot be either considered responsible for refund tickets or any other expenses.
The law of certain countries obliges you to have a passport, valid for at least six months after the return date of travel. Certain countries also demand individual passports for children even if they travel together with their parents and are already written into their passports. Organiser has made numerous links to inform citizens of EU about police, health and customs formalities, necessary for entering the country (-ies) of the destination or transit. It is up to the Buyer to check with the administrative authorities if this information is applicable to their situation, especially to minors.
Foreigners should check their registration and report their nationality as a comment for their personal files.

Offers of an apartment rental
In case of purchasing emplacement service only, the Organiser acts as an intermediary between the hotel and the Buyer. The Organiser cannot be responsible in case of force major (strikes, bad weather, wars, natural disasters, epidemics, technical incidents etc ...), any unpredictable actions of third parties, these of the Buyer or Provider. All expenses resulted on these unpredictable events (taxi, hotel, parking etc.) are the responsibility of the Buyer.
The prices are calculated depending on the number of nights and not of days. It means the available overnight period for a room. It varies from 2:00 p.m. to 6:00 p.m. on the day of arrival until the next noon. If the first and/or last night are shortened or extended because of a transport schedule - refund or compensation will not be granted. Thus, if the Buyer takes possession of his room, for example 2:00 am, 10 hours, during which his room was at his disposal (from 2 to 12) are considered a night and no compensation will be granted.
The rooms are available between 2:00 p.m. and 6:00 p.m. at the day of arrival, regardless of arrival time. They have to be vacated by the noon on the day of departure, regardless of transport schedule. Individual rooms usually include a single bed. These rooms are often a subject of a surcharge. The double rooms are provided with either two beds or rarely with a double bed.
The level of comfort of the hotels in the description corresponds to a classification by local standards of the host country, which may differ from this of your country. It is provided for informational purposes only. In case of force major or unpredictable actions of third parties, the Organiser has the right to substitute the originally booked hotel by another hotel of the same class with same services without any refund.
The Organiser is not responsible if certain activities proposed in the package are removed for reasons of weather or in case of force major.
- Modification of hotels, hotel eviction
For certain reasons the provider may be forced to change the listed hotels if this modification is not an essential part of the trip. Wherever possible, the Buyer will be beforehand notified in order to provide a service of the same category as originally proposed. No refund can be claimed by the Buyer.
- Transfers between airport or railway station and hotel
The following conditions are applied if transfers are included
- If your flight or your train is late for more than an hour but you have informed us at least three hours before the originally planned time, no additional expenses are charged.
- If your flight or your train is late for more than an hour but you have informed us less than three hours before the originally planned time, your transfer will be cancelled or we will provide another one for the price of 30 EUR per person.
The Organiser tries his best to show the photos and illustrations that will give the Buyer the best visual information on our proposals. These photos and illustrations are only to show the category of offered services.
Provision of car rental only
Unless the contrary is specified, the sale of car rental services is regulated by the specific conditions of providers. In the case of sale of car rental only, the Organiser is acting as an intermediary between the Renter and the Buyer. The Organiser cannot be responsible for any schedule modifications, delays, cancellations and other fortuitous events, cases of force major (strikes, bad weather, wars, natural disasters, epidemics, technical incidents etc ...) unpredictable actions of third parties, of the Buyer or Renter. All expenses resulted on these unpredictable events (taxi, hotel, parking etc.) are the responsibility of the Buyer
It is obligatory that the main driver has the driving license and credit card (with his name and surname) on the day of arrival. He should show the Renter his credit card and driving license. The rental companies require payments by credit card and some credit cards are not accepted by them (e.g. Electron, Maestro, Aurora etc...).
Touristic packages
All the proposals, estimations and organisation programs of site kazantipvoyage.com provide the prior information. Unless the contrary is specified, the characteristics, particular conditions and prices of trips indicated on the Internet site, are considered to be the contract conditions of sales. In case of breach of the contract, the assigner or the assignee should pay all the resulting expenses. If these expenses exceed the amounts mentioned in the contract, supporting documents must be provided.

The touristic package includes the provision of railway transport; the special conditions of using this transport are printed on the reverse side of a ticket. No change in itinerary or duration is allowed to the Buyer during travel without the consent of the Organiser. Any expenses due to the modifications made by the Buyer or in case of force major will be paid by the Buyer.
The Organiser is not responsible for any modifications in the schedule, itinerary or changing the station caused by exterior events such as: strikes, technical problems or weather. In this case the transporter’s liability is limited by international conventions regulating the railway transport.
They will be sent to the Buyer after the payment is done
- Transport documents (convocation of an airport for the charter, plane ticket for the regular flight, train ticket for the railway). If the customer has opted for an airport of its discount airline tickets, a notice will be sent by email for confirmation of his booking. It will be necessary to show this confirmation at the airport counter to get your tickets. If the customer does not receive such confirmation by mail, he must contact the agency or tour operator before departure.
The Organiser tries his best to show the photos and illustrations that will give the Buyer best visual information on our proposals. These photos and illustrations are only to show the category of offered services.
Reassignment of contract
The Buyer may assign his contract (excluding insurance) to a third person, under conditions of informing the Organiser by registered mail, not later than seven days before the trip. This mail must contain the exact names and addresses of the assigned person(-s) and of traveller(-s) confirming that they are under the same conditions for required trip.
The assignment of the contract means the following expenses for the Buyer:
- More than 30 days before departure 30 EUR per person
- From 30 to 7 days before departure 50 EUR per person
For certain companies and certain tariff basis the contract is valid since the very moment of sign and registration. For these cases a contract cannot be reassigned.
Your right for assistance
Organiser enables its clients a free contact of Skype exclusively dedicated to solving any tasks as for booked trips. The name of the contact for these free calls is club-ukraine. To receive this assistance, the Buyer must know the number of his booking and use it exclusively for monitoring the execution of the order.
Reclamation
INSURANCE INCLUDED The period of stay of every foreigner in Ukraine must be covered with a medical insurance. Insurance (assistance in case of illness or accident, medical expenses in Ukraine), provided by the company TAC, number 1 among Ukrainian insurance companies, is adapted for your trip to Ukraine. Subscribing to this insurance doesn’t lead to any additional expenses. It is included in the price of your trip.
In order to submit please indicate your Name and Surname exactly the same way, that they are written in your passport. This insurance is limited by covering medical expenses in Ukraine only. For example it doesn’t cover the repatriation.
- Expenses on cancellation and modification
Cancellation or modification of your booking leads to the expenses that are paid according to the scale below:
- booking of apartment before the day of your arrival - 30%
- for other services: airplane or train tickets 100% of price according to particular conditions of Providers
The cancellation or modification of your order for any reason does not exempt you from payment of debts that you owe to the organiser. In case of cancellation your insurance is not refundable.
We inform you that according to specifications applied by the transporters and the type of booking (ticket non-editable/non-refundable, expenses on emission of ticket etc.) some tickets cannot be refunded as told above. We kindly ask you to verify the conditions of cancellation, modification or emission in case of booking a ticket. As for the regular flights, all sections must be used, otherwise the airline company will have the right to adjust the price or to cancel tickets.
No right for reimbursement
The right for reimbursement, usually previewed for distanced sales is not applicable for the case of selling services of emplacement, transport, restoration and entertainments provided at a certain date or determined period.
Information required from a client
The Buyer is informed that his order is an object of nominal information. This info allows the Organiser and Providers to work for executing of the Buyer’s order. The right of access to info and rectification guaranteed by law is delegated to the Organiser by email: contact@kazantipvoyage.com
Miscellaneous
The fact that the Organiser does not take advantage of provided terms and conditions of sale should not be considered as a refuse to take this advantage later.
In case if any point of conditions of sale is declared void or unenforceable, this point of conditions is considered to be unwritten, if it doesn’t determine essentially the evaluation of other points. In this last case the parties will negotiate for replacement of this point with the one of equivalent economic value.
The Organiser is not responsible for the case of unpredictable events, force major (strikes, weather, natural disasters, problems of communications…), actions of the third parties, or the fault of the Buyer (late for the hour meeting, failure to comply with administrative, customs, health formalities, missing a flight).
Applicable law
The buyer must therefore bear all the financial consequences resulting on events of force majeure affecting the fulfil of obligations of the Organiser. The conditions of sale are regulated by the law of Ukraine. Any dispute concerning interpretation and/or implementation is in the competence of courts in Ukraine.
Contract
Before conclusion of the contract in the written form with its juridical data, address and authorised administrative activities, the Organiser should give to the Buyer information about prices, dates and other essential elements concerning the offered services for the trip, that are:
- Destination, means, characteristics and categories of used transport;
- Type of accommodation, its location, level of comfort and its general characteristics according to rules or traditions of the host country;
- Provided meals;
- The description of the itinerary in case of a tour;
- Administrative and sanitary formalities to fulfil in case of crossing the border and the time of their accomplishment;
- Visits, excursions and other services included to the package or that are available at an extra-cost;
- The minimal or maximal size of the group that allows realisation of a trip or stay, as well as, if the possibility of realisation of trip or stay requires some minimal number of tourists, the deadline of informing Consumer in case of cancellation; this date should not be indicated to less than 21 days before departure;
- The amount or percentage to be paid as a deposit on signing a contract as well as the schedule of payment of the rest;
- Terms of price revision, mentioned in a contract;
- Conditions of cancellation of a contractual nature;
- Conditions of cancellation;
- Details of covered risks and the coverage of the insurance contract on the consequences of the professional liability of travel agencies and civil liability of associations and agencies, nonprofit organisations, local touristic organisations;
- Information on the optional conclusion of an insurance contract covering the consequences of certain cases of cancellation of a contract covering certain specific risks, including costs of repatriation in case of accident or illness;
- If the contract includes air transportation – information for each flight section.
The contract concluded between the Seller and Buyer should be signed in two examples, one for each party. It should contain the following clauses:
- Name and address of the Seller as well as the name and address of the Organiser;
- The destination (-s) of a trip and, in case if a stay consists of several periods, their exact dates;
- Means, characteristics and categories of used transport, dates, hours and places of arrival and departure;
- Type of accommodation, its location, level of comfort and its general characteristics according to rules or traditions of the host country;
- A number of provided meals;
- The description of the itinerary in case of a tour;
- Visits, excursions and other services included in the price of a trip or a stay;
- The total cost of services billed as well as an indication of any possible review of the billing;
- Specification of existing charges or fees for certain services such as landing tax or boarding in ports and airports, touristic taxes - if they are not included in the price of package of services provided;
- The schedule and terms of payment; in any case the last payment should be made by the buyer not later than the day of arrival;
- Individual conditions demanded by the Buyer and accepted by the Seller;
- Terms during which the Buyer may claim the Seller for misexecution or bad execution of a contract; the reclamation should be sent without any delay by a recommended letter, reported when received by the Seller ; there should also be an informing letter to the Organiser of a trip and to the supplier of concerned services;
- The deadline of informing a buyer in case of cancellation of voyage by the Seller in case if realisation of voyage or stay depends on some minimal quantity of travellers;
- Conditions of cancellation of a contractual nature;
- Conditions of cancellation;
- Details of covered risks and the coverage of the insurance contract on the consequences of the professional liability of the Seller;
- Details concerning insurance contract of the Buyer, covering consequences in case of cancellation (number of insurance policy and the name of insurance agent), as well as that of assistance contract, covering some individual risks, e.g. expenses of repatriation in case of accident or illness; in this case the Seller should give Buyer a document, clarifying minimum of covered risks and risks excluded;
- Deadline for informing the Seller in case of contract breach by the Buyer;
- The commitment to provide to the buyer at least 10 days before the scheduled date of his departure, the following information:
- name, address and phone number of the local representative of Seller or alternatively the names, addresses and phone numbers of local agencies who can help Buyer in case of any difficulties, or alternatively a phone number to establish an urgent contact with the Seller;
- For the voyage or stay of foreign children, a phone number and address, that enables to establish direct contact with a child or a responsible person at the place of his stay.
- The clause of cancellation and refund without fees of the sums paid by the Buyer in case of non-servicing of required information
If after departure of the Buyer the Seller finds himself unable to provide a larger part of the services previewed in a contract and paid by the Buyer, the Seller should immediately take the following steps to reduce possible damage:
- either offer some services, replacing the one previewed in a contract and, if the services accepted by the buyer are of inferior quality, the seller must refund him the difference upon his return;
- or if there is no possibility to offer any alternative services or the Buyer refused all proposals for valid reasons, the Seller must assure, without any extra expenses, the means of transportation, that may be considered equivalent, to the place of a departure or any other place accepted by both parties.
